I would have, especially since he was trying to get a team into Canada. But I don't know anything else about him, maybe there was a more personal reason to why Gary denied him, or maybe he screwed up something in the past. I don't know.

There was a legal problem with his offer for the Coyotes. I forget what it was, but the judge was the one who ended up rejecting the offer.
